These Terms & Conditions (“Terms”) govern your use of timessquaremonk.com (the “Site”) and your purchase of products from Times Square Monk (“we,” “us,” “our”). The Site is powered by Shopify. (Times Square Monk)

By accessing the Site or placing an order, you agree to these Terms.

 Eligibility

You must be at least the age of majority in your jurisdiction (or have permission from a parent/guardian) to use the Site and make purchases.

 Changes to the Site or Terms

We may update the Site, policies, products, pricing, or these Terms at any time. Changes apply from the date posted. Your continued use means you accept the updated Terms.

 Products and availability

  • Product descriptions, photos, and pricing may change without notice.

  • We try to display products accurately, but color/appearance may vary by screen.

  • We may limit quantities or discontinue products at any time.

 Orders, pricing, and payment

  • Placing an order is an offer to buy. We may accept, reject, or cancel orders at our discretion (including for suspected fraud, pricing errors, or stock issues).

  • Prices are shown in the currency displayed on the Site and may not include taxes/shipping until checkout.

  • Payments are processed through Shopify and/or payment providers. (Times Square Monk)

 Shipping and delivery

  • Shipping options, costs, and estimated delivery times are shown at checkout.

  • Delivery times are estimates and not guaranteed.

  • Risk of loss transfers to you upon delivery to the carrier unless your local law requires otherwise.

 Returns, refunds, and exchanges

If you publish a separate Return/Refund Policy, that policy will apply and be incorporated into these Terms.

If you do not yet have one, here’s a simple default you can adopt (edit as you like):

  • Contact us within 14 days of delivery to request a return.

  • Items must be unused, unopened, and in original packaging.

  • Shipping costs are non-refundable unless the return is due to our error.

  • Refunds (if approved) are issued to the original payment method after inspection.

 Subscriptions and recurring orders (if applicable)

If you offer subscriptions in the future, you will clearly present billing frequency, cancellation, and renewal terms at checkout and/or in a subscription policy.

If you create an account:

  • You are responsible for maintaining confidentiality of your login credentials.

  • You agree to provide accurate information and keep it updated.

  • You are responsible for activity under your account.

 Acceptable use

You agree not to:

  • misuse the Site (hacking, scraping, introducing malware),

  • interfere with Site operation or security,

  • use the Site for unlawful purposes,

  • infringe intellectual property rights.

We may suspend or block access for violations.

 Intellectual property

All Site content (text, images, branding, logos, product names) is owned by Times Square Monk or its licensors and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute content without permission.

 User content (reviews, comments)

If you post reviews or other content:

  • you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with our business,

  • you confirm you have the right to post it and it does not violate any law or rights of others.

 Third-party services and links

The Site may include links or integrations (e.g., social platforms). We’re not responsible for third-party content, services, or policies.

 Disclaimers

  • The Site and products are provided “as is” and “as available,” to the maximum extent allowed by law.

  • We do not guarantee the Site will be uninterrupted or error-free.

  • Coffee-related taste notes and descriptions are subjective; results vary.

 Limitation of liability

To the maximum extent permitted by law, Times Square Monk and its affiliates will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

(Some jurisdictions limit these exclusions; in that case, the limitation applies to the maximum extent permitted.)

 Indemnification

You agree to indemnify and hold harmless Times Square Monk, its affiliates, and personnel from claims or demands arising out of your breach of these Terms, misuse of the Site, or violation of any law or rights of a third party.

 Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules, unless your local consumer laws require otherwise.

 Dispute resolution

Before filing any formal claim, you agree to contact us and attempt to resolve the dispute informally.
